END USER LICENSE AGREEMENT (EULA)
Please read the following terms and conditions of this End-User License Agreement (EULA) carefully.
Your use, distribution or installation of this copy of DESERT REVENANT (Herein mentioned as "Application") by KREATIONWARE FZ-LLC (The company that is offering this application and herein mentioned as "KREATIONWARE") indicates your acceptance of this License. It contains important information that affect you and your use of the game. By purchasing, installing or using this application and accepting this EULA, you agree to be bound by the terms of this agreement.
1.License to use the application
You are solely granted permission to use the application as per the terms of this agreement. This application is to be used only for personal and noncommercial use.
You are not permitted to sell, rent, sublicense, publish, copy, decompile, disassemble or commercially exploit the application without KREATIONWARE's official written consent.
2.Copyright and Intellectual Property
All title and rights of ownership and intellectual property in the application including: Texts, graphics, art assets, sounds and music, names, visual effects, lore, fictional characters, videos, dialogues, backgrounds, domain names, ideas, logos and any other component of the application, are owned and remain with KREATIONWARE and are protected by applicable copyright, patent, trademark, national and international laws and copyright treaties.
This license does not grant you ownership to the application, and you are therefore prohibited in selling the application directly or indirectly.
3.User Analytics
KREATIONWARE collects in-game user information in an effort to improve the User's gameplay experience by using third party analytics tools. The information collected includes: Game metrics, statistics, date and time spent on the application, time played, player details and achievements.
We do not distribute collected relevant information to any third party entity.
4.Disclaimer of Warranties and Limitation of Liability
You acknowledge that the application is provided "AS IS" without warranty of any kind, express or implied, and to the maximum extent permitted by applicable law. You waive all claim you may have against KREATIONWARE arising out of the performance or nonperformance of the application.
KREATIONWARE does not guarantee that use of the application will be uninterrupted or Error-free and will not infringe on the intellectual property or other rights of any third party.
You agree that KREATIONWARE is not responsible and/or liable for any loss or special, incidental or consequential damage incurred by the use of the application or any related services provided by a third party.
You agree to indemnify and hold KREATIONWARE harmless from all losses, damages, liabilities, debts, demands, claims, actions, causes of action, computer failure or malfunction, loss of goodwill, costs, charges and expenses including legal fees and any amount paid to settle any action or to satisfy a judgment in any way incurred or made by or against KREATIONWARE.
5.Termination
This agreement is effective from the first date you purchase, install or use the application. You and KREATIONWARE have the right to terminate this agreement at any time for any reason.
KREATIONWARE reserves the right to terminate to also terminate this agreement if you violate the terms and conditions mentioned in it.
Once the agreement is terminated, you must immediately delete the application and destroy at your own cost all the files, backup copies and associated materials of the application.
6.Modifications to the agreement or application
Changes, updates, revisions, amendments and modifications of this agreement can be made at any time without notice. You agree that you shall be responsible to review the current version of the agreement on kreationware.com. If you deem that the amendments to the agreement are unacceptable, you may terminate the agreement in accordance with Section 5, by permanently deleting and destroying all files, copies and associated materials with the application.
KREATIONWARE may change, update, revise or modify the application at any time for any reason, especially to update, repair or conduct maintenance. You agree that KREATIONWARE are not obligated to support earlier versions of the application once a new update is launched and that KREATIONWARE is also not compelled to provide maintenance or customer support for the application.
